Herd Technologies, Inc. d/b/a Perry, a Delaware public benefit corporation (“us”, “we”, or “our”, “Perry”), owns and operates the website located at https://www.joinperry.com/ (the “Site”) and related services. The Site and its tools, features and functionality are collectively hereinafter referred to as the “Service”. We provide our Service to employers pursuant to our terms and conditions or other written agreement with such employers. If you are an employee, please contact your employer to learn more about how Perry processes your information pursuant to such agreements.

Perry is committed to respecting the privacy of individuals. This Privacy Policy (this “Privacy Policy” or this “Policy”) describes the Information that Perry collects from individuals, how we protect that Information, how we use and share such Information and rights you may have regarding the Information you provide to us. “Information”, as we use the term in this Policy, means any information relating to an identified or identifiable natural person.

By visiting our Site and/or using our Service, you agree to the terms of this Policy. If you do not agree to this Policy, please do not access or use the Service. The Service is designed for individuals in the United States only and are not intended for individuals outside the United States. If you are located outside the United States and choose to provide Information to us, please note that the Information you provide is transferred to and processed in the United States, among other countries. Your consent to this Privacy Policy followed by your submission of such Information represents your agreement to that transfer.

Applicability

This Policy applies to Information which we ask that you provide to us in order to use our Service, as well as Information which we obtain by tracking and analyzing your use of the Site and Service. Additionally, please note that this Privacy Policy describes how Perry handles Information as a “data controller”, meaning all Information we process for our own purposes. It does not describe or apply to Perry’s handling of Information as a “processor” or a “sub-processor” of Information, including when we process Information to provide services to employers.

You may decide not to provide this information, but doing so may prevent you from using or accessing those features.

While using our Service, we may ask you to provide us with Information including:

  • First name and last name

  • Phone number

  • Address, State, Province, ZIP/Postal code, City

Payment Data and Transaction Information

We may collect payment Information in connection with your use of the Service through third- party payment processors.

Usage Data

Information from Other Sources

If you create or log into your account through a third-party site such as Google, we may receive access to certain additional Information from that site. We are not responsible for the accuracy of information provided to us by third parties and are not responsible for any third party’s policies or practices. Use of Information

We and our service providers process Information in order to:

  • Authenticate your identity;

  • Provide, personalize, maintain, optimize, and improve our Service, and enable you to participate in the interactive features of our Services;

  • Communicate with you, provide customer support, respond to your requests, questions and feedback and send announcements, updates, security alerts and administrative messages;

  • Conduct research and analytics relating to our Service and our business;

We may also de-identify and aggregate your Information for our own purposes. “De-identified” Information is Information that has been stripped of your identifiers, such as your name, contact information, and other identifying data, such that the information cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual. “Aggregated” Information is Information that has been combined with that of other individuals and analyzed or evaluated as a whole, such that the Information is not linked or reasonably linkable to any specific individual. Such information is not subject to this Policy.

Storage, Transfer, and Retention of Data

Perry is headquartered in the United States and has affiliates and service providers in other countries, and your Information may be transferred to the United States or other locations outside of your state, province, country or other governmental jurisdiction where privacy laws may not be as protective as those in your jurisdiction. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and that no transfer of your Information will take place to an organization or a country unless there are adequate controls in place regarding the security of your Information.

We will retain your Information as long as your account is active, and to the extent necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Please note that, except as required by applicable law or our specific agreements with you, we will not be obligated to retain your Information for any particular period and we are free to securely delete it or restrict access to it for any reason and at any time, with or without notice to you.

  • Comply with a legal obligation

  • Protect and defend the rights or property of Perry, including to enforce our terms

  • Prevent or investigate possible wrongdoing in connection with the Service

  • Protect the personal safety of users of the Service, our employees or the public

The security of your data is important to us. As a result, while we strive to protect your Information, we cannot ensure or warrant the security of any Information you transmit to us, and you use the Site and Service and provide us with your Information at your own risk. Cookies and Tracking Technologies

We and third parties on our behalf may use cookies and similar tracking technologies such as beacons, tags and scripts (together, “Tracking Technologies”) to collect Usage Data relating to your browsing activities, including your browsing over time and across different websites. We use Tracking Technologies to monitor the Service, run analytics, better understand user interactions with and improve the Service, tailor the Service to you and for security purposes.

Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of Tracking Technologies. You can instruct your browser to block or refuse all Tracking Technologies, to indicate when a Tracking Technology is being used or delete certain Tracking Technologies from your browser. However, blocking or deleting certain Tracking Technologies may cause some of the Service, including login features and general functionality, to work incorrectly.

Your browser may allow you to set a “Do Not Track” preference to inform websites that you do not want to be tracked when you visit websites. We do not support Do Not Track signals.

Our Service may contain links to other sites that are not operated by us. If you click a link to a site not operated by us, you will be directed to that third party’s site. Children’s Privacy

Our Service is not targeted or directed at children under the age of 13, and we do not intend to or knowingly collect or solicit Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Information to us, we encourage the child’s parent or guardian to contact us as described in the “Contact Us” section to request that we remove the Information from our systems. If we learn that Information we have collected has been provided by a child under the age of 13, we will promptly take all reasonable steps to delete that Information.

Your Rights in Your Information

You may at any time request that we update, correct, or delete your Information by emailing us at support@joinperry.com. Please note that we may ask you to verify your identity before responding to the request, and it may take us up to 30 days to process your request. Depending on where you reside, you may have other rights in relation to your Information, such as the right to request access to your Information, to receive a copy of your Information in a portable format, to object to our processing of Information and, where Perry relied on your consent to process your Information, withdraw your consent. Such rights are not absolute and may only apply in certain circumstances.

You may also opt out of marketing emails at any time by using the opt-out or unsubscribe instructions provided in the email. After opting out, you may still receive transactional emails from us, including emails about your account.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will let you know via e-mail and/or a prominent notice on our Service in advance of any change becoming effective, and by updating the “effective date” at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
